Transparency Index
The Index of Transparency of Courts and Prosecutor’s Offices consists of three key components:
- Proactive transparency, i.e. proactive publication of a set of information by courts and prosecutor’s offices on websites
- Reactive transparency, i.e. responses to requests for freedom of access to information sent to courts and prosecutors’ offices by Transparency International in BiH and individual requests from citizens
- Transparency of the judiciary towards the media, i.e. the submission of a set of information at the request of the media by the courts and prosecutor’s offices
The transparency index measures each of the component separately, the total sum of which gives the value of the transparency index, and the overall maximum score of the index is assigned on a scale of 0-100.
Proactive transparency measures the existence of 22 types of information on the websites of institutions, which concern institutional-organizational information, as well as information related to the transparency and openness of criminal proceedings.
Reactive transparency measures the responses of judicial institutions to requests for access to information in accordance with laws on freedom of access to information. Two requests were submitted to all courts and prosecutor’s offices, one from TI BiH and one individual from citizens, the average value of which gives the results of the index for this area.
The transparency of the judiciary towards the media measures the responses of courts and prosecutors’ offices to requests for the submission of a predetermined set of information.
